Child Custody Maintained

Matt’s client had lost custody of his child after he went to prison.

His ex-wife filed writ of habeas corpus and took the child from the stepmother, with who the child was most comfortable with.

Matt filed an intervention under Tex R. Civ. Proc. Petition for Modification with a special pleading requesting the court to authorize standing under Tex. Fam. Code Ch. 102 (9).

After the father was released from prison, Matt filed a counterpetition, a writ of habeas corpus, and a motion for the judge to confer with the child.

The case was tried over the course of 5 hours, and despite the father having recently been to prison, Matt was able to demonstrate to the judge that the best interest of the child was served by the father maintaining primary custody.
